4.6 Maternity Leave Provisions Under Massachusetts LawSection 105D of the Massachusetts Fair Employment Practice Law defines the entitlement of maternity leave for eligible female employees for a period not to exceed eight weeks for the purpose of giving birth or for adopting a child under the age of eighteen (or a child under the age of twenty-three if the child is mentally or physically disabled). Employees are eligible for leave under this law if they have been employed for at least three consecutive months as a full-time employee and if they provide their employer notice of at least two weeks of the need for leave. A notice of the provisions regarding maternity leave under Massachusetts Law, with details regarding eligibility criteria, rights and benefits, is posted in the campus Human Resources Department and in the Human Resources Office at Lincoln Laboratory. Employees should consult with their Human Resources Officers for information regarding leave provisions for pregnancy, childbirth, family care and adoption, to ensure that they are aware of their full rights under federal and state law as well as Institute leave programs.
